
Official Competition Rules and Terms

By participating in any phase of the #Songs4Planet Challenge, you are agreeing to the terms, rules, and conditions stated below.
1. Introduction
These are the Official Competition Rules governing the Songs4Planet Challenge (the “Competition”) presented by Global Peace Drive and Sol Okarina (“together called the Presenter”). The Competition is a new and innovative online contest wherein musical ensembles and soloists are judged based on online video submissions. Participants in the Competition are eligible to receive prizes, written feedback from experienced artists, and opportunities to be interviewed by the presenter. Additionally, the presenter may post participants’ video submissions online and via social media in order to share them with as broad an audience as possible. The ultimate purpose of the Competition is to provide participants with opportunities to be heard worldwide and to encourage the protection and conservation of our planet.
By making a submission to the Competition, you agree to comply with all of the terms and conditions stated in these Official Competition Rules, as well as with any terms proffered by third-party submission platforms.
Competition is in no way sponsored, endorsed, administered by or associated with Facebook.
2. Eligibility
The 2020 competition will be open to soloists and groups, though all prizes offered are one per entry/video.
Entrants must have a Facebook account to participate. Submissions must be set to PUBLIC.
Songs may be in ANY language, but to be eligible for the grand prize, the songs must be in English or Spanish.
Each song submitted must be Entrant’s original work. Songs may have multiple co-writers, but entrants must have permission from all writers to enter competition with co-written songs.
By making a submission, you (and each co-writer) are verifying that the submission is an original work; that you have complete authority to make the submission and have secured or are waiving all copyright protections in your country or jurisdiction/country to protect your work and shall hold Global Peace Drive and Sol Okarina (“together called the Presenter”) harmless thereon.
The topic of any material accepted is “Optimism, peace, hope, compassion, helping hands, uplifting and positive messages, caring for each other as humans, sharing consciousness, protection and conservation of our planet, earthlings and resources.” (TOPIC). Eligible submissions must be on topic to be considered, as determined by presenter in its sole and exclusive discretion;
The song should be original and unpublished.
Any Content must not include:
-
commercial content or content that references products, trademarks, logos, stores or websites of companies;
-
content that violates any third party intellectual property rights (including such rights in music and sound);
-
another person’s name, photograph, image, likeness or appearance, unless you have that person’s express written permission, which may be requested by presenters at their discretion;
-
material for which you were compensated or provided any consideration by a third party;
-
personal contact information for yourself or others;
-
corrupted files, viruses, or any other similar software files, the intent of which is to damage the operation of another’s computer;
-
content that is unlawful, threatening, harassing, abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, sexually explicit, hateful, profane, indecent, racially or ethnically derogatory, false, misleading or otherwise objectionable to presenter , as determined by presenter in its sole and exclusive discretion;

content that promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age;
-
content encouraging conduct that would constitute a criminal offense or promotes alcohol, drugs, tobacco, firearms/weapons;
-
content that could give rise to civil liability or otherwise violate any law; or
-
content encouraging conduct that is unsafe or dangerous or with any political agenda or message.
All submitted Content is subject to an approval process. The presenter reserves the right to refuse Content that does not comply with these requirements or for which you do not agree to these terms, at the sole discretion of the presenter. Any such selections are made at the presenter’s sole discretion.
Individuals under the age of 18 are welcome to participate with the express written consent of a legal guardian, which may be requested by presenters at their discretion
THE CONTEST AND ANY PERTINENT TERMS OF THESE OFFICIAL COMPETITION RULES ARE VOID WHERE PROHIBITED.
3. Repertoire
Applicants may submit a video no more than 5 minutes.
The repertoire selection is open to the applicant and all judging is done through video submission. The following rules/restrictions apply.
a.) The applicant can submit any unpublished, original piece in line with the competition TOPIC.
b.) There is no live round – all adjudication will take place online through video submission. It is suggested that the applicant submit as high quality of video as possible to give a fair representation of their song.
4. Contest Term
You must submit a high-quality video of you original, unpublished song (a "Submission") that complies with the requirements of these Official Competition Rules not later than May 28, 2020 at 11:59 p.m. Eastern Time (the "Submission Deadline") using the means described in these Official Competition Rules.
FIRST ROUND
The submission with the most Facebook LIKES before May 28th, 2020 at 11:59 PM EST will be awarded a guaranteed spot in the top 10 finalists that move on to the Final Round of the competition.
The presenter will choose 9 additional finalists from the First Round submissions, regardless of LIKE count. These choices/judgements are made at the sole discretion of the presenter.
These 10 finalists will be notified via Facebook Messenger on May 29th, 2020, and given 12 hours to accept the finalist position by completing a provided online registration form accepting the finalist position. If no acceptance is given, finalist position will be forfeited and defaulted to alternate finalists, under the same conditions.
It is important to note that only direct Facebook LIKES on the owner of the entry’s account will be counted.
FINAL ROUND
The 10 finalist submissions will be uploaded to Global Peace Drive in an album titled Songs4Planet Top 10 Finalists by May 30, 2020 - barring any unforeseen circumstances.
These 10 submissions will be put to public vote by Facebook LIKES. Whichever submission has the most Facebook LIKES by June 4, 2020 at 11:59 PM EST will win the competition.
The winner will be notified via Facebook Messenger on June 5, 2020, and given 12 hours to accept victory via Facebook Messenger response. If no acceptance is given, victory will be forfeited and defaulted to second place winner, under the same conditions.
It is important to note that only direct Facebook LIKES on Global Peace Drive’s account will be counted.
Contest will use its best efforts to announce the winners at the designated time, but will not be held liable for any unforeseen delays.
5. How to Enter
The following steps must be taken on Facebook.

3. 🎵 Upload your original song video, tag @GlobalPeaceDrive and @SolOkarinaMusic and use #Songs4Planet. Make sure it is a positive video about our planet! (Best if the video is recorded horizontally!)

5. Share THIS POST!
By participating in any round of the competition, contestants are agreeing to this contract.
If any entry required steps are not completed, entry is not valid (no exceptions).
6. Grant of License
By making your Submission, you assign all rights in any submitted video to the presenter, including granting the presenter permission to publicly display the Submission on its website, on YouTube, on Facebook & Instagram, or on any other media platform.
Those applicants under age 18 must have legal guardian consent to participate.
Specifically, your Submission grants presenter an irrevocable, paid-up, non-exclusive, perpetual, worldwide license to use, publicly perform, display, reproduce, transmit, sublicense, and distribute in all media formats now known or hereafter created the Submission in connection with (1) the Competition and the promotion of the Competition; (2) the promotion of future interactions of the Competition; and (3) the promotion of presenter in general (collectively, the "License"). The License will commence on the date you make your Submission.
By making your Submission, you represent and warrant that you have the right to grant the licenses addressed in these Official Competition Rules.
7. Indemnification
You will indemnify, defend, and hold presenter harmless from and against any losses (including reasonable attorneys’ fees) associated with any third-party action (a) arising out of your breach of any representation, warranty, or provision addressed in these Official Competition Rules; or (b) asserting or arising out of any claim that your Submission infringes or violates any law, regulation, or third-party right, including any intellectual property right.
8. Prizes
The following prizes will be awarded in each Phase of the competition.
FIRST ROUND
The entry with the most Facebook LIKES before May 28th, 2020 at 11:59 PM EST will be awarded a guaranteed spot in the top 10 finalists that move on to Phase 2.
The presenter will choose 9 additional finalists, regardless of LIKE count. These choices are made at the sole discretion of the presenter.
FINAL ROUND
All top 10 finalists will receive the following:

* The USD 500 will be awarded via mailed check if winner resides in the United States. If winner resides outside of the United States, the USD 500 will be sent via Western Union (or a mutually agreed upon method). It is important to note that any and all fees related to the transfer of fees will be paid by receiver.
** Accepting this prize is completely optional. Should the winner choose to have Sol Okarina perform his or her entry live in one of her upcoming concerts, he or she must be willing to sign additional documentation releasing the presenter of any and all liability and granting permission to Sol Okarina to perform and modify the song in accordance with her style. The contents of this agreement will be at the sole discretion of the presenter. Once signed, the agreement will have to be notarized. If the winner refuses to sign mentioned agreements, this prize will be forfeited. This prize is dependent on and subject to Sol Okarina’s physical ability to perform the entry. The date and time of the agreed upon concert is always subject to change.
All physical prizes that require shipping are offered within the continental United States. Winner will be responsible for international shipment if needed.
9. Additional Releases
By making a Submission to the Competition, you represent and warrant to the presenter that you are recording this work for the purpose of competition and release all rights to your performance to the presenter. Those applicants under age 18 must have their parent or guardian consent.
Additionally, the presenter may require each Winner or their parent/legal guardian to complete, execute, and return an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release, as well as certain other documentation reasonably requested by the presenter. Failure to respond to the presenter in a timely manner or failure to return documents in a timely manner may result in disqualification and selection of an alternate winner in the applicable Category(s).
Each Winner agrees to grant to presenter and those acting pursuant to its direction or control, the right to print, publish, broadcast and use, worldwide in all media formats now known or hereafter created, at any time or times, the Winner’s name, portrait, picture, voice, likeness and biographical information as news or information and for advertising, trade and promotional purposes without additional consideration, and without notification, review, or approval.
By accepting any prize or award, each Category Winner agrees that any Affidavit and/or Releases, and any grant of permission to use his or her name, portrait, picture, voice, likeness and biographical information, as stated above, may be secured by presenter electronically, for example but not limited to, by email or by facsimile, and such secured Affidavit and/or Releases and permission will have the same force and effect as if any of them had been secured in a written document which was executed by such person.
Further, by accepting any prize or award, each Winner releases and agrees to hold presenter harmless from any and all liability for any injuries, loss, or damage of any kind to persons and/or property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a prize, participation in any Competition-related activity, or participation in this Competition.
10. Limitation on Liability
Presenter assumes no responsibility for any error, omission, interruption, deletion, defect, delay, theft or destruction or unauthorized access to, or alteration of Submissions and other materials transmitted to the presenter in connection with the Competition. presenter is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer or Internet systems, servers, or providers, computer equipment, software, failure of any e-mail or Submission to be received by presenter on account of technical problems, human error, traffic congestion on the Internet, or any combination thereof.
Presenter is not responsible for any incorrect or inaccurate capture of information or the failure to capture such information, whether caused by the actions of third parties or by any of the equipment or programming associated or used in connection with the Competition and assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to the presenter website. Presenter is not responsible for injury or damage to any person’s computer or electronic device arising from or relating to participation in this Competition or viewing or downloading materials from the presenter website.
IN NO EVENT WILL FACEBOOK, PRESENTER OR ITS AFFILIATES OR RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SPONSORS, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, ARISING OUT OF YOUR PARTICIPATION IN THIS CONTEST, ACCESS TO AND USE OF THE PRESENTER WEBSITE AND SOCIAL MEDIA PLATFORMS, OR YOUR PARTICIPATION IN THE COMPETITION. PRESENTER MAKES NO WARRANTIES WITH RESPECT TO THE CONTENT OR FUNCTIONALITY OF THE ACCEPTED WEBSITE, AND YOU AGREE TO HOLD PRESENTER HARMLESS FROM ANY LIABILITY ARISING THEREFROM. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE PRESENTER WEBSITE AND SOCIAL MEDIA PLATFORMS, INCLUDING THE COMPETITION, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
11. Dispute Resolution
The presenter's decisions on all matters relating to this Competition are final and binding in all respects. These Official Competition Rules, transactions occurring under them, and the relationships created by them, will be construed and interpreted in accordance with the laws of the State of Ohio, United States of America, without regard to its conflict of laws principles. You agree that any and all disputes that cannot be resolved between you and presenter, claims and causes of action arising out of or connected with this Competition, or any prizes awarded, or the determination of the Winners will be resolved individually, without resort to any form of class action, exclusively by a state or federal court located in the State of Ohio, United States of America. You and the presenter agree to submit to the personal jurisdiction of the courts located within Warren County, State of Ohio, United States of America for the purpose of litigating all such claims or disputes. All parties waive any objection to the laying of a venue for any suit, action, or proceeding in such courts. The substantially prevailing party in any action will be entitled to recover its costs and attorneys’ fees.
12. Entire Agreement
These Official Competition Rules set forth the entire understanding between you and the presenter regarding the Competition and may not be modified except in a writing signed by an authorized representative of the presenter.
This agreement is subject to change without notice.
BY MAKING A SUBMISSION TO THIS COMPETITION, YOU (1) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THE FOREGOING RULES, TERMS, AND CONDITIONS, AND (2) AGREE TO BE BOUND THEREBY.
